Terms of Service

Welcome to HourProof. These Terms of Service ("Terms") govern your use of the HourProof mobile application ("App") operated by HourProof ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using HourProof, you confirm that you are at least 18 years old and agree to comply with and be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

HourProof is a mobile application that helps real estate investors track Short-Term Rental (STR) and Long-Term Rental (LTR) property management activities, log hours toward material participation goals, and maintain contemporaneous records with evidence attachments.

3. No Tax, Legal, or Financial Advice

THE APP IS PROVIDED FOR INFORMATIONAL AND RECORD-KEEPING PURPOSES ONLY. HOURPROOF DOES NOT PROVIDE TAX, LEGAL, OR FINANCIAL ADVICE.

The information presented in the App — including material participation thresholds, hour goals, and activity categorizations — is based on general interpretations of IRS rules and is not a substitute for professional tax guidance. IRS rules regarding material participation, real estate professional status, and rental loss deductions are complex and subject to change.

You should consult your CPA, tax advisor, or qualified tax professional for advice specific to your situation before relying on any records generated by this App for tax filings or IRS compliance. HourProof is not responsible for any tax consequences, penalties, or liabilities resulting from your use of the App or reliance on App-generated records.

4. Account Registration

To use HourProof, you must create an account using one of the following methods:

• Email and password
• Google Sign-In
• Apple Sign-In (iOS only)

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration.

5. User Data and Content

You retain all ownership rights to the data you enter into HourProof, including activity logs, property information, and evidence attachments. We do not claim ownership over your content. By using the App, you grant us a limited license to store and process your data solely for the purpose of providing the service.

6. Third-Party Services

HourProof integrates with the following third-party services:

• Google Sign-In: When you sign in with Google, we access your basic profile information (name, email, profile photo) as provided by Google's OAuth 2.0 API. We do not access your Google Calendar, Gmail, Drive, or any other Google services beyond authentication. Your use of Google Sign-In is subject to Google's Terms of Service and Privacy Policy.
• Apple Sign-In: When you sign in with Apple, we receive your name and email address (or an Apple relay email). Your use is subject to Apple's Terms and Conditions.
• OpenAI API: If you choose to use the AI-assisted logging feature, your activity descriptions are sent to OpenAI's API for processing. This requires you to provide your own OpenAI API key. Your use of OpenAI is subject to OpenAI's Terms of Use.
• Firebase: We use Google Firebase for authentication, data storage, and cloud functions. Your data is stored on Firebase servers subject to Firebase's Terms of Service.

7. Permissions

The App may request the following device permissions:

• Camera: To capture photos for evidence attachments.
• Microphone: For voice-to-activity input using speech recognition.
• Photo Library: To select existing photos as evidence.
• Speech Recognition: To convert voice input into text for activity logging.

All permissions are optional and requested only when you use the corresponding feature. You can revoke permissions at any time through your device settings.

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse-engineer, decompile, or disassemble the App
• Use the App to generate fraudulent records or documentation

9. Intellectual Property

The App, its design, features, and content (excluding user data) are owned by HourProof and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the App without our prior written consent.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. HOURPROOF DOES NOT PROVIDE TAX, LEGAL, OR FINANCIAL ADVICE. CONSULT A QUALIFIED PROFESSIONAL FOR SUCH MATTERS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOURPROOF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR TAX CONSEQUENCES RESULTING FROM RELIANCE ON APP-GENERATED RECORDS.

12. Data Backup

While we take reasonable measures to protect your data, you are solely responsible for maintaining backups of your activity records. We are not liable for any data loss.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the App settings. Upon termination, your data may be permanently deleted.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the United States and the state in which HourProof operates, without regard to conflict of law principles.
